]]>Changes have been made to the “Partner of a Worker”, work visa settings.
From 31 May 2023, many partners of workers who hold an Accredited Employer Work Visa (AEWV) or an Essential Skills Work Visa (ESWV) will need to work for an Accredited Employer and be paid at least the median wage, or if working in a role covered by an “Uncapped Sector Agreement”, they must be paid at least the relevant wage threshold.
These conditions will need to be met at the time the employer provides the offer of employment, or for those who are already employed, from the start date of the work visa (whichever is the latest). Any subsequent changes to the employer’s accreditation, the median wage and sector agreements will not impact the visa holder for the duration of the visa if they remain in the same employment.
Evidence of a job offer will not be required for obtaining such a partnership-based work visa.
The changes do not affect current work visa conditions or people who apply before 31 May 2023. There are also no changes to visa conditions for partners of New Zealanders or partners of those holding other work visas (such as a Post Study Work Visa for instance).
From 31 May 2023, people will also be able to check on the INZ website if an employer is accredited.

From 28 February 2023, the New Zealand Government is expanding work visa eligibility criteria for victims of family violence, to include partners of temporary visa holders.
You can now apply for this visa if you have experienced family violence and have been in a partnership with a New Zealand citizen or resident or hold a partnership-based visa with a temporary migrant.
This visa allows visa holders in New Zealand, who have experienced family violence, to live and work in New Zealand for up to six months. With this visa, you may work for any employer, anywhere in New Zealand.
If you are in immediate danger, call 111 and ask for the police. If not safe to speak, push 55 on a mobile (any number on a landline) to be put through to the Police. Or you may ask for Fire Service as they are often quicker.

]]>Partners of Accredited Employer work visa (AEWV) and Essential Skills work visa (ESWV) holders can currently apply for partnership-based work visas based on their relationship with AEWV or ESWV holders.
From 31 May 2023 onwards, partners of AEWV and ESWV holders will still be able to apply for partnership-based work visas, but if those visas are granted, they will be granted with conditions which will only allow work for accredited employers in jobs paid at, or above, the median wage (NZ$29.66 p/h) or paid at a lower wage threshold if the role is covered by an un-capped sector agreement.
Applicants for partnership-based work visas will not require a job offer to apply for these visas and will be able to change employers without formally varying the conditions of their visa.
Partners who do not want to work can also simply apply to join their partners in New Zealand on Visitor Visas.

]]>The new median wage of NZD $29.66 an hour will be adopted into the immigration system on 27 February 2023.
This will have an effect on various visa categories, including the Accredited Employer Visa (AEWV), occupations covered by sector agreements, and residence visa categories, such as the Green List and Highly Paid pathways, the Skilled Migrant Category, and the Parent Category.
Keep in mind that some roles are exempt from the AEWV median wage threshold, as some sectors have temporary agreements or exemptions that allow them to pay workers below the median wage in sectors such as the care workforce, construction and infrastructure, meat processing, seafood, and seasonal snow and adventure tourism sectors.

]]>• Immigration New Zealand (INZ) needs to ensure that people accepted into New Zealand, for longer than 12 months, have an acceptable standard of health.
• Further investigations about applicants’ health are usually triggered when they have a high Body Mass Index (BMI) (e.g. a level of over 35) and/or have other associated obesity-related conditions.
• It would be unusual for obesity, as a condition on its own, to cause an applicant to fail health screening requirements but applicants with a BMI of over 35 can expect INZ to make further inquiries about their standard of health.
